No waiver of any of the provisions of this or any Agreement shall be effective unless it is expressly stated to be such and signed by both Parties.

Payment and Product Terms


LIMITED WARRANTY

ARK NOVA INTERNATIONAL CORP. warrants to the original retail or first consumer purchaser that its wheels will be free from defects in materials and workmanship under normal and reasonable use for one year from date of purchase. ARK NOVA’s obligation under this Warranty is limited to the repair or, at ARK NOVA’s option, replacement without charge except for transportation, of any wheel which in ARK NOVA’s opinion is defective in material and workmanship.

This warranty shall not apply to:

1. Any defect, malfunction or failure caused by damage to wheels in transit, off-highway use, or by abuse, misuse, accident or negligence.

2. Wheels that have been altered or repaired.

3. Wheels that have not been installed in accordance with ARK NOVA’s instructions or installed on incorrect tire sizes or used with excessive vehicle loads.

4. Wheels that have been installed with other than ARK NOVA’s approved accessories such as center caps, etc.

5. Wheel corrosion or cosmetic flaws occurring after purchase due to car wash damage, chemicals, caustic cleaning agents, climate conditions or neglect.

6. Appearance defects in wheels that have been mounted after purchase or have been sold as a blemished product.

The ARK NOVA Warranty is valid only on wheels purchased in the United States and when the wheel is returned to the authorized dealer from whom it was purchase, freight prepaid together with proof of purchase.

There is no warranty that the wheel shall be merchantable or satisfactory for any purpose except such as is recommended in ARK NOVA’s printed application guides: nor is there any other warranty expressed or implied except such as is set forth herein.

THIS WARRANTY IS THE SOLE AND EXCLUSIVE WARRANTY GIVEN WITH RESPECT TO THE WHEELS AND ALL OTHER EXPRESS WARRANTIES ARE HEREBY EXCLUDED.
NEITHER ARK NOVA NOR AN AUTHORIZED ARK NOVA DEALER WHO SELLS THE WHEELS IS RESPONSIBLE FOR INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES.
SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS AND/OR DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES SO THE ABOVE LIMITAION ON IMPLIED WARRANTIES AND/OR THE LIMITAION OR EXCLUSION OF CERTAIN DAMAGES MAY NOT APPLY TO YOU.

Transfer of title of any ARK NOVA products by the original retail purchaser voids the warranty.

This Warranty gives you specific legal rights and you may also have other rights which vary from state to state.
